Provincial Government of Pakistan


Pakistan's four provinces enjoy considerable autonomy. Each province has a governor, a Council of Ministers headed by a chief minister appointed by the governor, and a provincial assembly. Members of the provincial assemblies are elected by universal adult suffrage. Provincial assemblies also have reserved seats for minorities. Although there is a well-defined division of responsibilities between federal and provincial governments, there are some functions on which both can make laws and establish departments for their execution. Most of the services in areas such as health, education, agriculture, and roads are provided by the provincial governments. Although the federal government can also legislate in these areas it only makes national policy and handles international aspects of those services.

 

Cabinet


In provincial government there shall be a Cabinet of Ministers, with the Chief Minister at its head and advice the Governor in the exercise of his functions.

Chief Minister

In Pakistan four provincial governments each province has chief minister who run the Whole administration with the help Governor and ministers. All provincial assambliesare unicameral, elected for five years. Governor appointed president with consulting the prime minister. When Chief Minister have to resign his office he writing his addressed and have to given  Governor.

Governor


Each provincial government of Pakistan has a Governor who should be appointed by the chief minister. He appoint from amongst the members of the Provincial Assembly. Article 130, the Governor shall appoint Provincial Ministers from amongst members of the Provincial Assembly on the advice of the Chief Minister. Governor may ask the Chief Minister to continue to hold office until his successor enters upon the office of Chief Minister. Governor also makes rules for the allocation and transaction of the business of the Provincial Government. He has to act in accordance with the advice of the Cabinet or the Chief Minister. When a Bill has been passed by the Provincial Assembly, it should be presented to the Governor for assent, he have to his assent within thirty day. When the Governor has returned a Bill to the Provincial Assembly it shall be reconsidered by the Provincial Assembly and if it is again passed with or without amendment by the Provincial Assembly, by the votes of the majority of the members of the Provincial Assembly present and voting, it shall be again Presented to the Governor and the Governor shall not withhold assent there from.

Qualification of chief minister and Governor


He should be a Muslim.

He should is not less those thirty-five years of age.

The Governor may, by writing under his hand addressed to the chief minister, resign his office.

he should be member of provincial assembly.

He should hold his office for the term of five years.

He name appears on the electoral roll for any area in the Province.

He is not declared by a competent court to be of unsound mind.

Acting Governor


When the governor is absent from Pakistan or is unable to perform the functions of his office due to any cause such other person maybe as the President direct ought to act as Governor.

Duration of Provincial Assembly


 Provincial Assembly dissolved for a term of five years from the day of its first meeting and shall stand dissolved at the expiration of its term. Governor should have to dissolve the Provincial Assembly if so advised by the Chief Minister and the Provincial Assembly sooner dissolved at the expiration of forty-eight hours after the Chief Minister has so advised.

Restriction on discussion in Provincial Assembly


No discussion should take place in a Provincial Assembly with respect to the conduct of any Judge of the Supreme Court or a High Court in the discharge of his duties

Advocate-General for a Province


 Governor of each Province shall appoint a person, being a person qualified to be appointed a Judge of the High Court, to be the Advocate-General for the Province. Its duty is to give advice to the Provincial Government upon such legal matters and to perform such other duties of a legal character as may be referred or assigned to him by the Provincial government. Advocate-General may by writing under his hand addressed to the Governor resign his office.

Relation between Governor and Chief Minister 


Chief Minister has to communicate to the Governor all decisions of the cabinet relating to the administration of the affairs of the Province and proposals for legislation. if the Governor so requires, to submit for consideration of the Cabinet any matter on which a decision has been taken by the Chief Minister or a Minister but which has not been considered by the Cabinet.

What is Local self government


Local self government is seen as an effective Method of administrating public services Pakistan adopted the same local government system which introduced by Britishers. In seventeen century the term local government is used first time in subcontinent. This system fist divide into Districts and districts were further divide into Tasil. Pakistan's experience of Local Government is unique as all the local government reforms carried out in its history have been initiated by the non-representative military regimes. The democratic regimes have undermined those reforms and have largely unwelcomed autonomous local governments. Pakistan have five provinces and each provinces and shall, by law, establish a local government system and devolve political, administrative and financial responsibility and authority to the elected representatives of the local governments.

Functions of responsible local government

Responsible Local Governance is not just about providing a range of local services, but also about achieving true participatory, liberal democracy that encourages civic dialogue, supports sustainable local development and facilitates outcomes that enrich the quality of lives of the people. Whether or not the enacted systems are capable of achieving these notions of good local governance is yet to be seen.

Local government of Pakistan (1947-2008)


British government formally introduced the system of Local Government in the mid nineteenth century. Through the system the British attempted to the local elite. An important feature of the British system of administration and local government was the creation of a rural-urban divide. After independence, Pakistan inherited local body institutions from the British. This system  remained  for a long period of 11 years due to lack of political consensus on the constitution.

The local self government continued to prevail and no remarkable progress was made until the military government led by General Ayub in 1959.  Ayub brought his own system of local bodies through basic democrats Order. He used this system for political purpose by getting their vote in the referendum in February 1960 for continuing his presidency  for five year  and for conferring authority in him to give a new constitution to Pakistan.

 Despite the fact that the Constitution established promotion of Local Institutions as ‘principles of policy’  under Article 32 were never implemented and In 1979 Zia Regime promulgated the Local Government  ordinance created four levels of municipal government in the urban areas Town Committees, Municipal Committees, Municipal Corporations and Metropolitan Corporations.

The period between 1985 to 1999 saw the rebirth of elected provincial and federal assemblies resulting in enhanced domination of provinces on Local Institutions. Many factors led to the suspension of the local bodies between 1993 and 1998.


Conclusion


As we discussed that politics leaders of Pakistan make provincial government just a tool which is used to strength their own purposes and position for the day of existence. As we concerned to the provincial government of mushraf he also used it for their own purpose. He first introduced new provincial government in Pakistan which had three times union council, Teshil council, District council. He also established Provincial Finance Commission to transfer to local bodies. He established Provincial Local Government Commissions to cheak and balance activities of provincial institution. He was fail to established responsible local govcernment, his fund of local government was misused this system apparently grounded on the principle of devolution, but in reality its was centralized. All the member of local government look up to Mushraf he used them for their own interest. the districts administration is in a state of confusion  and people do not know where to seek redress for their grievances. they confused as to who is responsible for policing, revenue administration magistracy in the district.
